Terms of Service

These Terms of Service (“Terms”) govern your use of ParkSwiz, operated by ParkSwiz LLC (“ParkSwiz,” “we,” “us,” or “our”). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use ParkSwiz.

1. Eligibility

You must be at least 13 years old to use ParkSwiz. If you are under 18, you represent that you have your parent or guardian’s permission to use the platform. We reserve the right to terminate accounts that violate this requirement.

2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate information during registration and to keep it current. One account per person — duplicate or shared accounts may be suspended.

3. Access & Waitlist

Access to ParkSwiz is by invitation or waitlist. We may grant or revoke access at our discretion. Invite codes are personal and may not be sold or traded. We reserve the right to modify or discontinue the waitlist, invitation, or Stardust-based access systems at any time.

4. Acceptable Use

You agree not to:

  • Use ParkSwiz for any unlawful purpose or in violation of any applicable law
  • Impersonate another person, misrepresent your identity, or create a misleading profile
  • Post content that is defamatory, threatening, harassing, obscene, or that infringes on the rights of others
  • Attempt to manipulate Stardust scores, ratings, or community reputation metrics through artificial means
  • Scrape, crawl, or use automated tools to extract data from ParkSwiz beyond what is provided via our public API endpoints (llms.txt, sitemap, RSS feed)
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform
  • Circumvent rate limits, authentication, or other security measures
  • Spam, solicit, or advertise without authorization
  • Upload malicious code, viruses, or any harmful content

Violation of these rules may result in account suspension, loss of Stardust, or permanent ban.

5. AI Concierge (Ask Swiz)

ParkSwiz provides an AI-powered chat concierge (“Swiz”) that generates responses based on community-contributed knowledge. You acknowledge that:

  • AI responses are informational and may contain errors. Always verify critical information (park hours, prices, ride closures, accessibility policies) with official park sources before making travel decisions.
  • Swiz does not determine eligibility for any park program, including the Disability Access Service (DAS) or any accessibility accommodation. Eligibility is determined solely by park operators.
  • Swiz is not a medical professional. Any accessibility-related information is general guidance based on community experience, not medical or legal advice.
  • ParkSwiz is not liable for decisions made based on AI-generated responses.

6. User Content

You retain ownership of content you submit (wiki articles, comments, Q&A answers, trip reports). By submitting content, you grant ParkSwiz a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, and distribute that content on and through the platform, including in AI-generated responses that cite your contributions.

Content that receives community citations earns Stardust for its author. You understand that published content may be indexed by search engines and cited by third-party AI systems via our public llms.txt and API endpoints.

We reserve the right to remove content that violates these Terms, is flagged by the community, or is determined to be inaccurate through our verification system.

7. Stardust & Reputation

Stardust is ParkSwiz’s reputation currency, earned through contributions and community participation. Stardust has no monetary value and cannot be purchased, sold, transferred, or exchanged for cash. We reserve the right to adjust Stardust balances, modify earning rates, or restructure the reputation system at any time. Tier status (Day Tripper, Keyholder, Gold Circle, The Architects, The Legends) is determined by accumulated Stardust and may be adjusted.

8. Payments & Subscriptions

Certain features require a paid subscription. Payments are processed securely by Stripe. By subscribing, you expressly authorize recurring charges to your payment method at the then-current subscription rate until you cancel.

Automatic Renewal. Subscriptions renew automatically at the end of each billing cycle (monthly or annual). You may cancel at any time from your profile settings or via the Stripe billing portal. Cancellation takes effect at the end of the current billing period — you retain access until then.

No-Refund Policy. ParkSwiz is a digital information service that provides immediate access to AI-powered theme park knowledge, community content, and planning tools upon subscription activation. Because the service is delivered and accessible immediately, all subscription fees are non-refundable. This includes partial billing periods, unused time remaining after cancellation, and subscription renewals. You acknowledge that you receive full value of the service from the moment your subscription activates.

Technical Issues. If you experience a technical issue that prevents you from accessing paid features, you must submit a support request to support@parkswiz.com within 7 days of the issue occurring. We will investigate and, if we confirm a platform-side fault that rendered the service materially unusable for a sustained period, we may issue a pro-rated credit toward future service at our sole discretion. Credits are not cash refunds and have no monetary value outside the platform.

Dispute Resolution Before Chargeback. You agree to contact us at support@parkswiz.com to resolve any billing concern before initiating a chargeback or payment dispute with your bank or payment provider. Filing a chargeback without first contacting ParkSwiz support constitutes a breach of these Terms and may result in immediate account suspension, loss of Stardust, and forfeiture of all content contributions. We reserve the right to dispute any chargeback we believe to be fraudulent or filed without a good-faith attempt to resolve the issue directly.

Price Changes. We reserve the right to change subscription pricing with 30 days’ notice. Price changes apply to the next billing cycle after the notice period. If you do not agree to a price change, you may cancel before it takes effect.

Free access to disability and accessibility information is always maintained regardless of subscription status.

9. Accessibility Information Disclaimer

ParkSwiz provides accessibility and accommodation information compiled from community experience, publicly available resources, and official park documentation. This information is provided “as is” for trip planning purposes only.

ParkSwiz does not provide medical advice, make disability determinations, or serve as a substitute for official park accessibility services. Accommodation programs (including DAS, Rider Switch, and similar services) are administered solely by park operators, and their availability, requirements, and policies may change without notice. Always confirm current accessibility services directly with the park.

When you provide accessibility preferences in your profile, you consent to that information being used to personalize your experience on ParkSwiz. This data is functional accommodation preference data, not medical or health data. See our Privacy Policy for details on how this data is handled.

10. Intellectual Property

The ParkSwiz platform, including its design, code, AI models, knowledge base structure, and Swiz character, is the property of ParkSwiz LLC. You may not copy, modify, or distribute any part of the platform without written permission.

Walt Disney World, Magic Kingdom, EPCOT, Hollywood Studios, Animal Kingdom, and all related park names, attraction names, and character names are trademarks of The Walt Disney Company. Universal Orlando, Islands of Adventure, and related marks are trademarks of NBCUniversal. ParkSwiz is not affiliated with, endorsed by, or connected to any park operator. Use of these names is for descriptive and informational purposes only.

11. Third-Party Links & Services

ParkSwiz may contain links to third-party websites, partner services, or external tools. We are not responsible for the content, accuracy, or practices of any third party. Your interactions with third parties are governed by their own terms and privacy policies.

12. Disclaimers

ParkSwiz is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that any information provided (including AI-generated content) will be accurate or complete.

13. Limitation of Liability

To the maximum extent permitted by law, ParkSwiz LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to damages arising from inaccurate AI responses, missed reservations, changes in park policies, or reliance on accessibility information. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is less.

14. Indemnification

You agree to indemnify and hold harmless ParkSwiz LLC from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your violation of these Terms, your content, or your use of the platform.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may delete your account at any time from your profile settings. Upon termination, your right to use the platform ceases immediately. Sections 6 (license grant), 8 (payments and no-refund policy), 12-14, and 16-17 survive termination.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of ParkSwiz shall be resolved in the state or federal courts located in Orange County, Florida. You agree to submit to the personal jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform at least 14 days before the changes take effect. Your continued use after changes constitutes acceptance. If you do not agree to the updated Terms, you must stop using ParkSwiz and delete your account.
